ZapRoute Terms of Service

ZapRoute ("the Service") is operated by Emanuel Pools, Corp., 9956 Brickhill Dr, Boca Raton, FL 33428, United States ("we", "us"). These Terms are the agreement between us and the company that subscribes to the Service ("you", "your company"). By creating an account or using the Service, you accept these Terms. If you are creating an account on behalf of a company, you confirm that you are authorized to bind that company.

Your privacy is covered separately by our Privacy Policy, which forms part of this agreement.

What ZapRoute is — and what it is not

ZapRoute is software for pool service businesses: it builds daily routes, records visits, stores photo proof of service, tracks filters, salt and chemistry, and produces reports for the owner. We are a software provider.

We do not perform pool service, we do not employ or supervise your technicians, and we are not a party to the relationship between your company and your customers.

ZapRoute does not give chemical advice. The Service records the readings and the products your technician enters, shows whether a reading falls inside the range your company configured, and alerts your office when something looks off. It does not tell anyone which chemical to use, and it does not calculate how much to apply. Those decisions belong to the trained professional servicing the pool, who remains solely responsible for water chemistry, chemical handling and compliance with the rules of their trade.

Mileage, fuel cost and route timing shown by the Service are estimates to help you plan, not exact measurements.

Accounts, roles and your team

Your company's owner account creates and manages the accounts of the rest of the team, each with a role (technician, field supervisor, office, estimator, owner). You are responsible for who you give access to, for what they do in the Service, and for keeping credentials secure. Revenue and billing figures are never shown to technician or field-supervisor roles.

The Service is a professional tool for businesses. It is not directed at children and it is not intended for personal or household use.

Free trial

New companies get a 30-day free trial from the day the account is created, with no credit card required. A promotional code may extend the length of the trial; codes never change the price.

We warn you inside the app 7 days before the trial ends. If no subscription is started, access is restricted in steps: the day after the trial ends, owner and office roles are blocked; technicians and field supervisors keep working for 7 more days. Even when blocked, you can always sign in, see your subscription status and subscribe. Nothing is deleted when a trial ends.

Subscription and price

The subscription is monthly and recurring, in U.S. dollars, and the price depends on how many pools your company runs:

$59 per month for up to 60 pools · $99 per month for up to 99 pools · $1 per pool per month from 100 pools upward. A company with no pools is billed at the lowest tier: the subscription is for the system, not for a pool.

Sales tax is calculated at checkout based on the billing address you provide and is added to the price shown.

How pools are counted

This is the part worth reading twice, because it decides your bill.

On the 1st of each month (America/New_York time) we count your pools and record the result. The number used is the greater of these two:

(a) Pools visited last month — each distinct pool with at least one visit that was not voided during the previous calendar month. Repair visits do not count. Two visits to the same pool in the same month count once.

(b) Pools active today — each pool that is active, belongs to an active customer, has at least one route day, and has no open suspension. A pool registered only for a repair, with no route days, counts in neither number.

If your company grows during the month, the price goes up right away. When adding pools moves you into a higher tier, the difference for the remaining days of the month is charged immediately. The price never goes down in the middle of a month. Suspending, deactivating or deleting a pool does not produce a refund or a credit; the reduction is applied at the next monthly count.

We may change our prices. If we do, we will give you at least 30 days' notice by email before the new price applies to your subscription.

Payment

Payment is handled by Stripe on our website. Card details never pass through ZapRoute and we never see or store them. There is no purchase inside the mobile apps — on iPhone and iPad the app only tells you to manage your subscription at zaprouteapp.com.

When you are charged. Your billing date is the day your free trial ends, and it repeats on that same day every month — it is not the 1st. If your trial ends on the 5th, you are charged on the 5th of each month. If you add a card with fewer than 3 days of trial left, you are charged that day instead, and that day becomes your billing date.

The 1st of the month is when we count your pools; the count we take is what you are charged on your next billing date. Because the two dates are different, a bill issued in the first hours of a month may still carry the previous month's count.

If you add a card while at least 3 days of trial remain, nothing is charged that day: the first charge lands when the trial ends.

If a payment fails, your subscription is marked past due and you keep access under the same stepped schedule described for the trial, counted from the end of the period you already paid for. If payment succeeds later, access returns automatically.

Text messages to your customers

The Service can send SMS to your customers on your behalf. Messages are sent from a single shared toll-free number used by all ZapRoute companies, and every message begins with your company's name, so your customer knows who is writing. Automatic message texts are in English only.

Consent is your responsibility. SMS is off by default for every customer. You must have your customer's consent before turning it on, and you must be able to show how and when that consent was given — the Service records the date and origin you enter. You are responsible for complying with the laws that apply to business text messaging, including the TCPA. Customers can reply STOP at any time to opt out, and we honor it automatically.

Messages are only sent inside your company's local sending window (8:00 to 20:00 by default; you may narrow it). Messages that fall outside the window are discarded, not queued for the next day.

Message charges. Your plan includes 10 standard texts per active pool per month. Anything beyond that, and every message classified as additional (reminders, announcements, office replies), costs $0.02 per message, added to your next invoice. During a trial no message is charged, but additional messages are capped at 50 per month.

The "service done" message includes a public link to the service photo that works without a login and expires in 30 days. Anyone with that link can see that photo.

Photos, and what the AI does

A photo is required as proof of every service visit. Photos are stored on our servers, attached to the visit record, and kept as your company's service history. They are also copied to a secondary backup so they are not lost if a provider fails.

Photos are analyzed automatically by an AI service to classify the type of service shown, to read chemistry test strips, and to detect duplicated or altered images. The AI assists; it does not decide. A person in your office can always correct what the AI recorded, and nothing the AI concludes is treated as final proof against a technician without a human reviewing it.

Fair use: the AI analyzes up to 5 photos per visit. From the sixth photo onward the photo is still uploaded, still stored and still shown as proof — it simply is not analyzed. No photo is ever refused or deleted for this reason.

We do not use your photos or your company's data to train AI models.

Your data is yours

Your customers, pools, visits, photos, chemistry, repair orders and reports belong to your company. We process them to run the Service for you and for no other purpose. We do not sell them and we do not share them with other companies using ZapRoute — data is separated per company at the database level.

You are responsible for having the right to enter the personal data of your customers (name, address, phone, email) into the Service, and for the accuracy of what you enter.

Cancelling

You can cancel at any time, with no contract and no cancellation fee, from the Stripe billing portal reachable inside the Service. You keep access until the end of the period you have already paid for.

Payments already made are not refunded, including the current month, because the Service was available to you during it. Cancelling does not delete your data.

Deleting your account

An owner can delete the whole company account from inside the app; any other team member can delete their own access. Deletion is not immediate: the account is switched off right away, the subscription is cancelled, and the data is permanently erased 30 days later. Until that date you can cancel the deletion and get everything back.

Your photos live in two places — our main storage and a safety copy at Google Cloud — and both are erased on day 30. Our storage provider keeps that copy recoverable for up to 7 further days as protection against an error on our side; it is not accessible to us as data, and after that window it is gone.

After that date we keep only the minimum required for tax and accounting — subscription and payment records (amount, date, tax) for 7 years. Those records contain no photos, no customer names, no addresses and no pool data, and no one can sign in to them.

Acceptable use

Do not use the Service to break the law, to send messages to people who have not consented, to upload content you have no right to, to attempt to reach another company's data, to probe or overload our systems, or to resell the Service as your own. We may suspend an account that is doing any of these, and we will tell you why.

Availability

We work to keep the Service running every day, because a technician's route depends on it. Even so, the Service is provided "as is", without any guarantee of uninterrupted or error-free operation. We depend on third parties (hosting, database, maps, messaging) and on your internet connection. We do not offer a service-level agreement, and planned maintenance is scheduled outside route hours whenever possible.

Limitation of liability

To the maximum extent allowed by law, we are not liable for indirect, incidental or consequential damages, for lost profits, for lost customers, or for damage to a pool, equipment or property arising from a service decision made by you or your team. Our total liability for any claim is limited to the amount your company paid us in the 12 months before the claim.

Some states do not allow certain limitations, so parts of this section may not apply to you.

Changes to these Terms

If we make material changes, we will update this page, change the effective date above, and notify the owner account by email at least 30 days before the change takes effect. Continuing to use the Service after that date means you accept the new Terms.

Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Palm Beach County, Florida, and both sides consent to that jurisdiction.
